Welcome to Genius of You. These Terms & Conditions govern your access to and use of our website, assessments, results, reports, digital products, content, community spaces, emails, and any related services we provide.

By creating an account, taking an assessment, purchasing a product, accessing your results, or otherwise using Genius of You, you agree to these Terms.

If you do not agree to these Terms, please do not use Genius of You.

This draft is not legal advice and should be reviewed by an attorney before publication, especially because Genius of You allows some users under 18 to participate.

1. What Genius of You Provides

Genius of You helps users reflect on their strengths, energy patterns, work preferences, personal tendencies, and possible life or career directions through assessments, reports, written insights, digital resources, and related guidance.

Our products may include, but are not limited to:

• Free assessments;
• Paid assessments or reports;
• Career guidance products;
• Personalized results pages;
• Digital resources;
• Emails or educational content;
• Community, coaching, or future related offerings.

Genius of You is designed to support reflection, self-understanding, and decision-making. It does not replace professional advice from a therapist, doctor, lawyer, financial advisor, career counselor, recruiter, school counselor, or other licensed professional.

2. Eligibility and Minors

Genius of You may be used by adults and by minors who meet the requirements below.

If you are under 13 years old, you may not create an account, take an assessment, submit personal information, or use Genius of You unless we have created a separate experience that expressly allows your use with appropriate parent, guardian, school, or organizational consent.

If you are between 13 and 17 years old, you may use Genius of You only with permission from a parent or legal guardian.

By using Genius of You, you represent that:

• You are at least 18 years old; or
• You are between 13 and 17 years old and have permission from a parent or legal guardian to use the service.

If you are a parent or legal guardian and you allow a minor to use Genius of You, you agree to these Terms on the minor’s behalf and are responsible for the minor’s use of the service.

If you are using Genius of You on behalf of a school, company, nonprofit, employer, community organization, or other organization, you represent that you have authority to agree to these Terms and to provide any required consent for the users you invite, enroll, or support.

We may suspend or remove accounts if we believe a user does not meet these eligibility requirements.

3. Accounts and Signups

To access certain features, you may need to create an account or provide information such as your name, email address, assessment responses, and other information related to your results.

If you are between 13 and 17 years old, you should only create an account or take an assessment with permission from a parent or legal guardian.

If you are a parent or legal guardian and believe a minor has created an account or submitted information without your permission, please contact us at support@geniusofyou.com. We will review the request and take appropriate action, which may include deleting the account or associated data.

You agree to:

• Provide accurate information;
• Keep your login credentials secure;
• Not share your account with others;
• Not create an account for someone else without proper permission;
• Notify us if you believe your account has been accessed without permission.

You are responsible for all activity that occurs under your account.

We may suspend or terminate accounts that violate these Terms, misuse the service, attempt to interfere with the platform, or create risk for Genius of You or other users.

4. Assessment Responses and Results

Your assessment results are generated based on the information you provide and the Genius of You framework.

You understand that:

• Your results are interpretive, not definitive;
• Your results are intended to support reflection and decision-making;
• Your results should not be treated as psychological, medical, clinical, legal, financial, academic, or employment advice;
• Your results may not capture every aspect of who you are;
• Career-related suggestions are not guarantees of job placement, income, satisfaction, promotion, admission, or success;
• Life-related suggestions are not instructions about what you must do with your life.

You are responsible for how you interpret and apply your results.

Genius of You may continue improving its framework, scoring, language, product experience, and outputs over time. As a result, assessment outputs, product features, and recommendations may change.

5. Guidance for Younger Users

If you are under 18, your Genius of You results should be treated as a reflection tool, not as a fixed identity, diagnosis, label, or instruction about what you must do with your life.

Your interests, strengths, preferences, goals, and circumstances may change over time. You should discuss important school, work, career, health, financial, or personal decisions with a parent, guardian, teacher, counselor, mentor, or other trusted adult.

Genius of You is not intended to pressure young users into any specific career, identity, path, school choice, or life decision.

6. No Guarantees

We aim to provide useful, thoughtful, and practical guidance. However, we do not guarantee any particular outcome from using Genius of You.

We do not guarantee that:

• You will find a specific job, career, school, relationship, path, or opportunity;
• Your results will feel perfectly accurate;
• Your results will remain unchanged over time;
• A suggested direction will be financially viable or personally fulfilling;
• Any third party will respond positively to language, insights, or recommendations derived from your results;
• Your results will lead to a specific life, academic, employment, or career outcome.

Your life, work, career, education, and personal decisions remain your responsibility.

7. Payments, Pricing, and Refunds

Some Genius of You products may be free. Others may require payment.

By purchasing a paid product, you agree to pay the price shown at checkout, including any applicable taxes or fees.

Payments may be processed by a third-party payment provider, such as Stripe. We do not directly store your full payment card information.

Unless otherwise stated at checkout, paid products are for individual use only and may not be shared, resold, copied, or distributed.

Purchases by Minors

If you are under 18, you may only purchase a paid Genius of You product with permission from a parent or legal guardian.

If a purchase is made by a minor without proper permission, a parent or legal guardian may contact us at support@geniusofyou.com. We will review the request in accordance with our refund policy and applicable law.

Refunds

If we offer a refund policy, guarantee, or satisfaction period, the specific terms will be stated on the relevant checkout page or product page.

For example, if a 60-day satisfaction guarantee is offered, refund requests must be submitted within 60 days of purchase using the contact method provided.

We reserve the right to deny refund requests that appear fraudulent, abusive, duplicative, or inconsistent with the stated refund policy.

8. User Content and Information You Provide

You may provide assessment responses, written reflections, feedback, messages, testimonials, or other content to Genius of You.

You retain ownership of content you provide. However, by submitting content, you grant Genius of You a limited license to use, store, process, analyze, and display that content as necessary to provide, personalize, operate, maintain, and improve the service.

You agree not to submit content that:

• Is false, misleading, or impersonates someone else;
• Violates another person’s rights;
• Contains unlawful, abusive, harassing, or discriminatory material;
• Includes confidential information you are not authorized to share;
• Contains malware, spam, or harmful code.

If you provide feedback, ideas, suggestions, or product comments, you agree that we may use them without restriction or compensation to you.

9. Testimonials and Public Feedback

If you provide a testimonial, review, quote, or other public feedback, you give Genius of You permission to use it for marketing, product, sales, and educational purposes.

We may display your first name, last initial, role, company, photo, or other identifying details only if you provide them or authorize their use.

If you are under 18, we will not knowingly use your name, image, testimonial, or identifying information for public marketing purposes without appropriate parent or legal guardian consent.

You may contact us to request removal of a testimonial. We will make reasonable efforts to remove it from future use, though previously published materials may not be immediately removable from all channels.

10. Privacy

Your use of Genius of You is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your information.

Minors’ Privacy

We take minors’ privacy seriously.

If you are between 13 and 17, you should only use Genius of You with permission from a parent or legal guardian.

If you are a parent or legal guardian and believe your child has used Genius of You or submitted personal information without your permission, please contact us at support@geniusofyou.com. You may request that we review, delete, or restrict use of the minor’s information, subject to applicable legal, security, and operational requirements.

Unless we expressly state otherwise, Genius of You is not intended for children under 13.

11. Intellectual Property

Genius of You, including its assessments, scoring methods, frameworks, reports, written language, result types, designs, branding, website content, product structure, and related materials, is owned by Zone of Genius Institute or its licensors.

You may use your personal results for your own reflection, personal development, job search, career planning, education planning, and related individual purposes.

You may not, without written permission:

• Copy, reproduce, or distribute Genius of You assessments or reports;
• Reverse engineer, scrape, or extract the scoring system;
• Create a competing product using our frameworks, questions, outputs, or content;
• Sell, license, publish, or commercialize Genius of You materials;
• Use our name, logo, or branding in a misleading way.

All rights not expressly granted are reserved.

12. Acceptable Use

You agree not to misuse Genius of You.

You may not:

• Use the service for unlawful purposes;
• Interfere with the security or operation of the website;
• Attempt to gain unauthorized access to accounts, systems, or data;
• Scrape, crawl, or harvest content without permission;
• Submit false or misleading information;
• Use the service to harass, discriminate, exploit, or harm others;
• Resell or commercially exploit the service without written permission;
• Use automated tools to take assessments, generate results, or overload the system;
• Use Genius of You to make decisions for another person without their knowledge or proper consent.

We may restrict, suspend, or terminate access if we believe you have violated these Terms.

13. Third-Party Services

Genius of You may use or link to third-party services, including payment processors, analytics tools, email platforms, hosting providers, scheduling tools, community platforms, or external websites.

We are not responsible for third-party websites, services, content, policies, or practices.

Your use of third-party services may be governed by their own terms and privacy policies.

14. AI, Automation, and Product-Generated Content

Some Genius of You features may use automation, algorithms, or artificial intelligence to generate, refine, or personalize content.

You understand that automated or AI-assisted outputs may be incomplete, imperfect, or occasionally inaccurate. You should use your judgment before relying on any generated content.

Genius of You may review, improve, test, or modify automated systems over time to improve product quality and user experience.

If you are under 18, you should review any important interpretation or decision based on Genius of You results with a parent, guardian, counselor, teacher, mentor, or other trusted adult.

15. Service Availability and Changes

We may update, improve, modify, suspend, or discontinue parts of Genius of You at any time.

We do not guarantee that the service will always be available, uninterrupted, secure, or error-free.

We may release new features, remove old features, change pricing, update assessment logic, revise reports, or modify the user experience.

If a paid feature is materially changed or discontinued, we will make reasonable efforts to communicate relevant updates when appropriate.

16. Disclaimers

Genius of You is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

We do not warrant that:

• The service will meet your expectations;
• The results will be accurate or complete;
• The service will be uninterrupted or error-free;
• Any defects will be corrected;
• The website will be free from viruses or harmful components;
• The service will produce a particular personal, academic, emotional, career, financial, or professional outcome.

17. Limitation of Liability

To the fullest extent permitted by law, Genius of You and its owners, employees, contractors, partners, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes damages related to:

• Career decisions;
• Education decisions;
• Employment outcomes;
• Lost income;
• Lost opportunities;
• Emotional distress;
• Reliance on assessment results;
• Service interruptions;
• Data loss;
• Unauthorized access;
• Third-party services.

To the fullest extent permitted by law, our total liability for any claim related to Genius of You will not exceed the amount you paid us in the 12 months before the claim arose, or $100 if you did not pay us.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

18. Indemnification

You agree to defend, indemnify, and hold harmless Genius of You, its owners, employees, contractors, partners, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:

• Your use of the service;
• Your violation of these Terms;
• Your violation of another person’s rights;
• Content or information you submit;
• Your misuse of assessment results or product materials;
• Your use of Genius of You on behalf of another person or organization without proper authority or consent.

19. Termination

You may stop using Genius of You at any time.

We may suspend or terminate your access if:

• You violate these Terms;
• You misuse the service;
• We believe your use creates legal, security, privacy, or operational risk;
• We discontinue the service or a portion of it;
• We determine that you do not meet the eligibility requirements.

After termination, provisions related to intellectual property, payments, disclaimers, limitation of liability, indemnification, and dispute resolution will continue to apply.

20. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Venue for any dispute will be located in the state or federal courts located in Santa Clara County, California, unless otherwise required by applicable law.

21. Dispute Resolution

Before bringing a formal legal claim, you agree to first contact us at support@geniusofyou.com and attempt to resolve the issue informally.

Please include:

• Your name;
• Your account email;
• A description of the issue;
• The outcome you are requesting.

We will make reasonable efforts to respond and resolve the issue.

If the issue involves a minor user, the parent or legal guardian may contact us on the minor’s behalf.

Optional lawyer-review clause to consider adding later: binding arbitration and class action waiver. This should not be added casually without legal review, especially for a consumer-facing product that may include minors.

22. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may notify you by email, website notice, account notice, or other reasonable means.

The updated Terms will be effective when posted unless a later date is stated.

Your continued use of Genius of You after the updated Terms become effective means you accept the updated Terms.
